Distance Sales Agreement

1. PARTIES

This Agreement has been entered into between the following parties within the framework of the terms and conditions specified below.

By accepting this Agreement, the BUYER acknowledges in advance that, upon confirming the order subject to the agreement, they will be obligated to pay the price of the order and any specified additional charges such as shipping fees and taxes, if applicable, and that they have been informed accordingly.

2. DEFINITIONS

For the application and interpretation of this Agreement, the terms written below shall have the meanings specified opposite them.

  • MINISTER: The Minister of Trade,

  • MINISTRY: The Ministry of Trade,

  • LAW: The Consumer Protection Law No. 6502,

  • REGULATION: The Distance Contracts Regulation,

  • SERVICE: Any consumer transaction other than the supply of goods, performed or undertaken to be performed in return for a fee or benefit,

  • SELLER: A natural or legal person who offers goods to the consumer within the scope of their commercial or professional activities, or who acts on behalf of or for the account of a person offering goods,

  • BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for purposes other than commercial or professional purposes,

  • SITE: The internet website belonging to the SELLER,

  • ORDERING PARTY: A natural or legal person requesting a good or service through the internet website belonging to the SELLER,

  • PARTIES: The SELLER and the BUYER,

  • AGREEMENT: This agreement concluded between the SELLER and the BUYER,

  • GOODS: Movable property subject to purchase and software, audio, visual, and similar intangible goods prepared for use in an electronic environment.

3. SUBJECT

This Agreement regulates the rights and obligations of the parties pursuant to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation concerning the sale and delivery of the product ordered electronically by the BUYER through the internet website belonging to the SELLER, whose characteristics and sales price are specified.

The prices listed and published on the site are the sales prices. The published prices and offers remain valid until they are updated or changed. Prices published for a limited period remain valid until the end of the specified period.

7. INFORMATION ABOUT THE PRODUCT/PRODUCTS SUBJECT TO THE AGREEMENT

7.1. Basic Characteristics

The basic characteristics of the goods, product, products, or service, including their type, quantity, brand/model, color, and quantity, are published on the internet website belonging to the SELLER. If a campaign is organized by the SELLER, the basic characteristics of the relevant product may be reviewed during the campaign period.

7.2. Prices

The prices listed and published on the site are the sales prices. The published prices and offers remain valid until they are updated or changed. Prices published for a limited period remain valid until the end of the specified period.

7.3. Taxes and Payments

The sales price of the goods or services subject to the agreement, including all applicable taxes, is shown below.

Invoice delivery: The invoice will be delivered together with the order to the invoice address during order delivery.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read and become informed about the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the agreement on the internet website belonging to the SELLER and have provided the necessary confirmation electronically.

9.2. Delivery Period

Each product subject to the agreement shall be delivered within the period specified in the preliminary information section on the internet website, depending on the distance of the BUYER's place of residence, provided that it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

In cases where the distance contract concerns the sale of goods, the BUYER may exercise their right of withdrawal from the agreement by rejecting the goods without giving any reason, provided that they notify the SELLER within 14 days from the date the product is delivered to the BUYER or to the person or organization at the address specified by the BUYER.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal may not be exercised for products prepared according to the BUYER's request or clearly in line with their personal needs, products that are unsuitable for return due to health and hygiene reasons and whose protective elements such as packaging, tape, seal, or package have been opened after delivery, as well as other goods and services specified in the applicable legislation. Determine the exceptions applicable to your business with legal counsel.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER makes payment by credit card and falls into default, the BUYER accepts, declares, and undertakes that they will pay interest and be liable to the bank in accordance with the credit card agreement between the cardholder and the bank.

13. COMPETENT AUTHORITIES

In consumer disputes arising from this Agreement, applications may be made to the competent consumer arbitration committees or consumer courts in accordance with the applicable legislation.

14. EFFECTIVENESS

The BUYER shall be deemed to have accepted all terms of this Agreement upon making the payment for the order placed through the Site.
